Why are you setting the NISCOPE_ATTR_MIN_SAMPLE_RATE attribute? This will be ignored, or overwritten by the NISCOPE_ATTR_SAMP_CLK_TIMEBASE_RATE attribute. How are you setting this attribute? Your error indicates that you are setting this to 12.499750 e12 while the maximum sample rate for your board (5114, I assume) is 250 MS/s.
What do you mean by "When I consistently increse the first one it couses an increase of the second one" when referring to MIN_NUM_POINTS and MIN_SAMPLE_RATE? These two attributes are independant of each other.
Perhaps if you sent me a section fo your code, I can see what is happening.
